UPS: Undelivered Package and trying to charge me for Duty and Taxes on it.
So my story start last March, when i placed and orders on some pipes for the local University's FSAE team. Everything seemed to be going well with the tracking till we hit the canadian border. They showed the duty and taxes on there, and thats where the track stops. I called up UPS to see what was going on, called the company that delivered the goods to put a trace on it with no luck. After a couple of weeks I couldn't wait any longer for the trace and had to reput another order from that same company as we were on a tight schedual to finish the car and that had already put me back a couple of weeks. This time though I had the seller ship it through USPS and a week later I received my package.
About a month later, I receive a letter from UPS stating that I need to pay for the duties and taxes on the package that I never received from them. After a few phone calls and them admiting it wasn't delivered, they said that the trace wasn't done but they'd take care of things.
6 month later roughly, I get another letter from a Collection Agency (RMS). I called them up and explained to them the situation, they told me they'd look into it and to also contact UPS. I contacted UPS, and said that it would be taken care of again.
Fast forward to a month ago, I get another letter from RMS saying that I still owed the money to UPS and had 2 weeks to pay it or else... I called up UPS in a fury, and they told me that they don't have any more records except for the fact that I still owe the amount of 93.45$CA. Frustrated, I called up the RMS company again, and told them how can they even charge for something they don't have any record of being delivered or anything. They transfered me to guy (Degachi) and told me that I'd receive an email of the full UPS transaction within a week. Didn't get anything in my email till 3 days ago showing the export date, custom charges, but no received date.
I tried calling the RMS company a couple of days ago and i kept on getting "The number you have dial is no longer in service" until today. Didn't try calling them again but I have a feeling I might be getting another dead end. I did call up UPS a couple of days ago too and tried to talk to the them again. The guy on the phone asked for my phone number, which I had previously given them to contact me with concerning any other question regarding the lost package, and said there was no previous numbers on file with that matching number neither but said he'd put it in and they'll have someone call in before 10am next day. Of course next day, no phone call. I was busy and didn't have time to call them back up and wait on the line again to deal with the same thing.
So my real delima is that I don't want to have bad credit just because of this and I know i can just pay the damn thing to get it out. But why pay for something that wasn't delivered, delayed our project from its original deadline, giving me nothing but headache, and trying to corrupt my credit!!! I would of gladly paid it had i received that package. If my last resort is claims court, then it'll have to be it altough I know nothing on how to deal with stuff like that. So I come seeking guidance.

Collection agencies rarely report anything to the credit bureau. They buy another companie's old debt and try to collect it. You have asked for the supporting documentation regarding the alleged debt and they are unable to provide it. I think the saga will end there. Unfortunately, the debt will probably get resold to another company and you'll have to go through the whole thing again. I would probably put something down in writing to both UPS and the current collection agency. From your post you have only described verbal assurances. Send a self serving letter that details everything you described in your post to UPS legal and the collection agency.

ups sucks I will not ship anything with them EVER!
they have lost items, they have tried to double charge me duty, tax and their inflated brokerage .
if there is something I really want in the u.s.a and the only way they will ship is ups
I will either have it shipped to a us address then have it usps ed up or I will not buy.

Oh i know they suck, but the guy was insisting on using UPS. As far as documents, like I said all they have is that the package is sent out and hit the border, but nothing after that.

I got a package from Fed-Ex.About ten days later I receive a bill for Customs.
"on behalf of You(ME) the customer,we have paid the Customs fee.Now you owe us,Blah,blah...WTF,If I would have known,I would have Shipped it back.In the long run,I could have got the Part In Canada For Way less.Top it all off,it was a USED part.
UPS,at least I Know that they will Charge,and hand you a Bill,before you get the item,No surprises there.I expect it now,From anything shipped by UPS.
USPS,is Just Down right SLOW,as Fark.I am still waiting on a package from a Guy.I think the parts Now have more miles than the Space Shuttle.For all I know the parts could be in Some Customs Guy's Ride,and he is "testing them"!

Ya fedex does do that ... but you should just expect it. I really haven't had any problems with USPS really... been nothing but good to me.

I've had a similar experience with being told I owe money by a collection agency and the way I handled it was to write letters to [ company name ] which thought I owed them money.
If you write professional looking properly formatted business letters explaining why you will not pay, you may have to rewrite a similar letter as 'they' like to ignore the first ones they get, then the collection agency will just stop trying to contact you; at least they stopped for me.
The key is UPS needs written dated documentation from you. I would guess after you write two maybe three letters thet will be the end of it. Oh ya, you can write nasty letters just don't swear in them.

Based on the fact that you did not receive the item you are not going to get written confirmation of anything. You are simply supposed to ask for their supporting documentation to make the idiots understand that they screwed.
Unfortunately that would actually take thinking on someone's part. So you write a self-serving letter detailing everything that occurred on the transaction and why you do not owe them a dime. That is the end of it. If you keep getting requests recycle the same letter until someone with a brain answers you or they leave you alone.
And remember talking on the phone means nothing, you have to do it in writing.
Now don't write a novel. Keep it short and to the point.
1. I ordered X on X
2. I was given a tacking number on X
3. You bastards never delivered it as of X etc. (refrain from profanity and subjective comments as much as possible)

UPS will leave the package at your door if you're not home AND they will be stolen if you don't make it home. If a signature is not required its "Drivers discretion."
I remember once they left packages at my door even though signatures were required. . . idiot driver. I absolutely loathe UPS. Heck I just finished dealing with them today. Next time I'm telling every buyer/seller that I will NOT support UPS service. *curse* them

This all makes me tremendously glad that I live and work in a place where within an hour I can go to the US, pick up a package, bring it across the border myself and be back at home.
I usually avoid UPS like the plague, but within the US they seem to be pretty good, their brokerage fees are down right criminal though.

x1,000,000 on not ever delivering by ups again. If a company only ships by ups, I phone them up and ask if they will ship fedex. Otherwise I won't purchase the item. Right now I believe I have a $20 owing to them but its completely retarded so no way in hell i'm paying it.
UPS stinks, period. I live on a farm in the boonies of rural Manitoba, they won't drive out here, I don't blame them for that, and if they can't get hold of me to meet them they take it back to Brandon, I've even driven into Brandon, 100 kms, to get my stuff at my expense. I will not accept UPS shipping on my purchases from the US, USPS works well for me and I can pick up my stuff from the Post Office
on Saturdays as well. Won't use FedEX either as they cannot cope with the fact that I do not live in a city.
