Need a Lawyer's help.

Hey, so i've got an FD in the states, had it inspected, got a shipping quote and an customs broker to do the border paperwork, but i need a lawyer to go and get the title and sign a bill of sale with power of attorney.

If any of you guys are lawyers or know laywers, and know who I could call, or what this would cost, could PLEASE help me out, i'd certainly appreciate it. i'm at a loss. I've sent a couple of emails out to lawyers i've found on internet listings and websites, but i always get the response that they can't help me out, because they don't do that sort of thing.

The vehicle is in Santa Barbara, CA.

you should be able to do the sale via fax
then get a bonded carrier to transport it to a customs yard in calgary.
I purchased a car from the u.s. and everything was done via fax and
i had searail pick the car up, they took it to a yard in edmonton
and i went to the customs office (at the airport) and did all the paper work there
in person, paid the tax and in a couple day picked up the car after the customs people
inspected it.

Well the problem that i'ts a private sale

And I get squeemish about the idea of somone having my money AND the car, and the title.

And there is extra paperwork in getting the current owners lien removed from the car.

I got the car inspected and pretty much promised to buy it, but this becomes more and more of a p.i.t.a. with each person I call. We'd have to go to the bank, get the lien removed, go to the DMV, get a new title with the bank removed as owner, and for that it needs to pass smog, which it just failed the visual portion of.

If it was a dealer car, I'd have no problem, at least you're dealing with someone you can track down and sue.

So I've only got one option left, to go through a local mazda dealer and hope they'd buy the car, and flip it back to me for 500$, but they've not gotten back to me, so i doubt its going to happen.

I'm going to eat the cost of inspection, chalk it up as a learning experience and start my search anew.

If they are willing to do it, you can give your shipping company the power of attorney. May want to check into this option.

Well, good news.

The owner called me, and he's ordered the parts to have it pass smog (original airbox) and he's going get the lien removed from the car, and the time it takes to do that, he's going to give me to arrange a good way to transfer the title.

Yah, it's goregeous.

compression checked out at 98 - 96 98 -97 but htey didn't test each seal on its own. Leaks a bit of oil from the oil pan or the frong crank case, service manager at the local mazda dealer said the the oil pan is kind normal, has to do with some seal, and ifs the front crank case, it's going to to be about 350 to fix that.

I asked if the care would make a few thousand k on a road trip and he said, sure, but qualified that with a "but you never know, it's an rx-7 remember".

I've got a new plan, i'm going to go to a mazda dealer local to me tomorrow, and then get them to call the mazda dealer there, and then the guy can just bring the car into the local mazda and they'll get me a bill of sale and the title. This sounds to simple to work, so it has to. I'll just have them wire money through a dealer transfer, and the shipping company can pick the car up at the mazda dealer there.

I mean, it's another local FD, that's gotta be worth at least 3K a year to them

the smog issue was that the DMV in California wouldn't be able to remove the bank on the title, without it first passing smog there. If owner were in sole possesion of the title, i just need to have it, in that case, smog wouldn't be an issue.

Well, good and bad news.

Mazda won't touch it, their dealer network is only in Canada. Probably would be a different story if the car was up here. I could probably get it ti work, if i knew someone well, or had bought a car or two off someone here. I can't blame them for not wanting to do this for someone out of the blue.

So, good news.

My attorney is going to get me a referrecne of some people he works with in LA, and hopfeully they can then referr me to someone Local to the seller in California who i can give power of attorney and they'd could hold the car in trust for me until it's shipped or i decided i wanted to makea 2700km trip in an FD (not likely). It won't be cheap, but I guess its the only way to do it.

Anyone know what something like this costs to do?

Soloracer951 did it this way, and he made it sound like it was painless except for a bit of a legal bill.

Fly down and drive it home, it'll be an experience for sure and that way you have the car and the ownership when you're handing the guy payment so you're not going to get screwed.

Worried about the car making the trip. I don't plan to but 2700 km's a year on it, let atlone in a weekend.

I'd still have to get a lawyer to get the documents done in time though, copies of bill of sale and title have to be at the border 72 hrs before i am.

But i think i will drive, i showed my father, and he's kind of bored and wants to stop in vegas. I don't think he apprciates what "being back to work by monday" means anymore.

NOOO!!! Don't drive it back on these salted roads!

If it were summer I'd say drive it back for sure. Being winter it would be such a shame to spray salt all over it when it's never seen salt ever before.

Well, i'm back to frustrated again.

I've been calling laywers all week and no one will touch this. I mean, It's not like i'm being suspicious or anything, and they're lawyers for ***** sake, if it was some kind of scam, you think you'd want to AVOID calling lawyers.

Thanks to everyone who's pm'd me trying to help me out, i was really encouraged till about yesterday afternoon, when all my legal inquiries started coming back to me.

I just can't realistically, go down and get the car till after breakup, and even then, i don't really want to do the deal myself.

Dammit all to hell.

Man I hope you can work something out, surely someone else must have run into this problem before? Maybe try posting in another forum?
There must be some way to enlist the services of a bonded carrier to pickup the vehicle and deliver the payment all in one go. Would be a shame if it all falls through, don't quit now!

I've looked at almost every option i think there is out there. Lawyer is the only route, somone has to go to the bank and verify the lien has be paid out, etc.. etc.. Joey Mc. Car hauler, isn't goin to do that.

I'll just keep looking, put the feelers out locally, there must be some nice FD's tucked away in rich oil men's garages around town.
