head light ticket

Well this is my first ticket with my 7

I was coming out of a drive through after a 12 hour shift and forgot to re raise the headlights after waiting in line

Boom 250 $ ticket for failure to have functioning headlights.
I apologized and spoke to him in a kind manner.
I was not even on the road yet and was going to raise them as soon as i left the lot

Oh well I'm not complaining but it was a funny night.

Were you on private property or did you actually drive on a public road with no lights. If you were still on private property the ticket may be null and void, either way go to court it should of been just a warning. Dam quotas!

I'd fight it too. That's BS! I would have told the cop I'm sorry I just simply forgot to turn them on. Then I would have turned them on an off a bunch of times just to prove he's being a dick. I'm sure if you explain your situation in court they would drop the ticket.

Definitely fight it. You weren't on a public road yet - and it's not like your headlights didn't work. Not like he can come and give you a ticket in your garage, or your driveway either.

Now that's complete bull... He can't give you a Highway Act ticket on private property. It makes no sense at all....

As everyone has said, the highway traffic act does not apply on private property. Also, did the cop let you leave with your non-functioning headlamps? That would be a safety violation on their part. (with the obvious assumption that this situation occurred at night.)
