Description: I needed a working Logicon for my '88 RX7, and after reading Omixeo's FS post here, I contacted him and worked out a price of $40 shipped. I MADE A MISTAKE by only sending $35 Paypal, since I had some other quotes for this amount. I promptly sent him another $6, for a total of $41 to cover the extra trasaction fee. This was August 7 and 8, 2007. My payment mistake was corrected within 24 hours. I requested he send me a tracking # when he shipped. He had 500+ posts, had been a member for 2 years, and he did not show up in the bad trader forum, so I had no concerns over the transaction.

I received a PM from him on 8-15-07 advising he had forgotten to ship it, but would do so tomorrow & send me the tracking number. I replied this was not a problem. As of 9-5-07, I still had neither the part nor the tracking number, so I sent another PM (I had been offline due to technical problems for 1.5 weeks) advising it had not been received & requesting the tracking number. On 9-7-07, I opened a Paypal inquiry since it had been 30 days with no item. I received a response from him on 9-10-07 advising he had been out of town and had forgotten to send it. He again promised a tracking number. I thanked him & advised I would close out the Paypal inquiry once the item was received. On 9-14-07, I sent another PM advising him I needed a tracking number by 9-15-07 or I would have to escalte the Paypal inquiry to a dispute. I did not receive anything from him by that date, so I escalted both transactions into a dispute. He has not responded to the Paypal requests. If he does not respond by 9-25, the claim will automatically be decided in my favor.

As of 9-15-07, I bought another Logicon here, so now I need my money back.

As of today 9-20-07, he last shows as being online here on 9-10-07.

I believe this is a case of inattentiveness. My buy/sell ethic is to pay/ship as applicable within 24 hours of an agreed deal/payment being received. I use FedEx to ship, and they send an email with the tracking number automatically to the buyer. I do not as a seller ever hold a buyer's money for an extended length of time without shipping. I treat others as I would expect to be treated. There are always problems that arise, such as my connection being down for 1.5 weeks, but the amount of time that has passed along with two promised ship/tracking number messages is unreasonable.

I realize this ethic is not shared by others, and have experienced here in the past that the simple act of inquiring three days after payment was sent is seen as an offense to one seller (not Omixeo). This does not change how I do business. It does change who I do business with, though.

As an update, Paypal decided the claim in my favor since Omixeo did not respond. I got a partial refund and his account is suspended until the balance is paid.
