Question Are there any insurance adjusters or lawyers around?

So, a friend (not me, seriously) is in a bad situation.

Had FD at a shop so had taken collision off the car with his existing insurance company. Left basic coverage.

was going to pick up car, called and added collision back on that morning.

That afternoon, on the way home owner sadly had a very bad wreck in torrential downpour and badly totaled the FD.

Now the insurance company is telling him he's not covered because they were still 'processing the coverage.'

Evidently he's been with them for 3 years and has done this (taking liability off then adding it later) three times now.

The car is in bad shape, makes me sick to look at it. He's ok luckily. This all happened in NJ, he lives up in CT.

It's my opinion that in this case he needs to get a lawyer involved.

Thoughts, comments, advice, questions?

Maybe Adam can weigh in. But if they said they're still "processing the claim" then they haven't refused it...right? How long is it been since the accident?

Rich, I think that would be they were still processing the "coverage" not a claim.

From my personal experience, it's going to be tough as most insurance companies will stick by whatever time and date they "bind" the insurance. What they are trying to tell your friend (and it may very well be false) is although he called to add the insurance, the policy had not been updated, thus no coverage.

Did they tell him on the phone the coverage was added versus they were gong to process it? If so, I'd probably get a lawyer involved and take a run at it as insurance companies notoriously deny most everything and only those that pursue get a more just settlement.

When it comes to auto insurance and my FD, I leave nothing to chance. Just had to update insurance when I relocated to NC and I made sure, after my phone calls with American Collectors and State Farm (had to split the coverage due to weird NC laws), I had them immediately email me the coverage binding documents and temp ID cards.

The best thing here is your friend wasn't hurt and maybe he and others will take more precaution due to this.

I can tell you that 100% he would be converted if he have full coverage put on prior to the accident. You have coverage from the minute you add it (ex: 5/14/15 1:23pm). He can fight that all day long.

And I have been an adjuster for 10 years... Only other consideration is if he had an agent or was buy the coverage directly? If he told his agent and the agent didn't add the coverage he would be screwed unless it was via email. He needs to show proof of the date and time he added the coverage.

Once coverage is added, it is covered at that moment. Its that simple.

Your friend shouldnt need an attorney. If the company denies the claim, he will need to report it to the state insurance commissioners office. They wont let them get away with this.

A call from his agent to the claims people should help (unless his agent is a weenie)
