well spandy if you were driving your FD in that particular spot at that time of night im sure you would have hit it too. Law states they must post up signs warning you of the hole... im not th only one to hit it, i talked to a guy that works at the A&W right next to it and he says people come in and bitch about it all the time. and for me im only 5'8" i sit kinda lower in my car, i COULD NOT SEE THE HOLE... so now you tell me how its my fault, i never knew the hole was there till i was in it and yes i was paying attention because i had to drive around the flatbed

That does suck about the car though, but who was sitting in the driver's seat when it rolled in?


By the way, how fast were you going? That's a good amount of drop, but at 5mph (what you should be doing in a parking lot) I just can't see how it did that much damage.

Now at 30+mph, that would make sense.


While I agree that some of the things that people sue over nowadays are on the ridiculous side, I don't think that applies here. From the pictures you can tell its not very well lit, and the size of the pothole is a little deceiving. We are all entitled to our opinions, but I don't think he is at fault here.

I think the owners of these malls owe it to their shoppers to have a well lit, and smoothly paved parking lot. Especially where one enters and exits the lot. Anything less is complete bullshit. Unfortunately, most mall owners would prefer to leave things as they are, and rely on people's reluctance to pursue any claims.

With all of that said, I try very hard to know a parking lot front to back before I drive my FD into it. If there is construction of any type going on, I just avoid it completely. I realize that this is impractical to those that DD their FD's, but this is the reason why I kept my POS escort.


FD3Smaniac: Good luck with your repairs. Hopefully it wont be too difficult to get the owner to pay up.

crcleofdst, thanks for the support, ill keep you guys updated on how this whole thing turns out... another bomb was dropped on me last night... girlfriend is pregnant, so if anyone knows of a car for sale around phoenix arizona let me know, im looking for maybe a mid 90's subaru, or sumthin like that, never know im open to all suggestions really

damn thats a pretty ****** big pot hole....your car actually looks better for hitting a big hole like that....mines would of been dead at the spot with no bumber and bent rims....man i feel sorry for you bro......sue..get your money and call it a day.

The picture of scrapes from other cars bottoming out says it all. Take even better pictures that show the whole ruler measuring the height, file a claim and take them to court.
