Thanks for clearing that up for me John. I spoke to Andrew and he said that these pics he gave me for free (which he posted on my Facebook and possibly other places by the way) were not to be used in the calendar. But if I paid for some he had no problem with me using those pics. He also explained to me his normal process and the unique circumstances of these shoots since I hadn't requested he shoot the car, it just kinda happened.

Graham, who shot the other pics, did tell me he has no problem with me submitting his pics for the calendar.

However, after all this, I'd like to remove any and all pics from submission and don't want any pics of my car to be used for this calendar or any other calendar, or anything else for that matter. I just have a hard time understanding why the photographer gets all rights to use photos they took of an object they don't even own, but the owner of that object does not have the same rights. Shouldn't I be allowed some compensation for pics of my car being used to promote their business or whatever? Just doesn't seem right.

Mods, please delete all of my posts in this thread, at least where I have posted pics of my car.

You know what I agree with you

-The photographer profits indirectly or directly from your own blood, sweat, tears, time, and money that went into building the object that it is being captured and you get zero compensation for it. That's not right.


but also at the same time:
- I also see that the photographer uses his expensive equipment, skills, and time to capture the shot. Only to have his work be given away to make a calendar that is being sold and thus have someone else profit from it. That ain't right either

But no one can deny that is sure is cool to see their pride and joy in a calendar

For photographers, each picture is a "product". As mentioned above, photographers invest lots of money into expensive equipment to produce these quality images. In addition to that, each image is individually edited in a post processing program such as photoshop. Sometimes several hours can be spent on a single image. When its all said and done, each image is a pretty large investment for the photographer (including time).

When he took the pictures of your car, you gave consent (directly or indirectly) for him to photograph your car. I understand the amount of time and money you put into building the car, but remember it cost him time and money to produce these images as well.

He has posted the images online, so you are free to enjoy the images and post them for others to see. However the issue is that by publishing the images SOMEONE ELSE IS PROFITING FROM HIS WORK. That is what this all comes down to.

I have intimate knowledge on the topic because at one point I was using photography as a source of income... and built my own car which has been photographed by others.

If you want ultimate control over what happens to the images, then you will have to make the full investment to purchase them.

Speedjunkie and JhnRX7.... excellent looking cars. I'm starting to think twice about keeping the my original tail lights. These cars all look so good. Speedjunkie, what kind of hood is that? What did you do with the fenders? Looks very nice.

I think you would need some sort of agreement, signed by you or at least been told clearly up front about who owns the photo rights. It seems like a little bit of a gray area which creates a responsibility on the part of the photographer to inform you about it. Assuming no agreement or knowledge otherwise, If you were given digital copies I think you can do what you want. He may be a good guy you would not want to upset though.
