Yes, they are voluntary, but no one at the check point will tell you that. These check points are designed to catch less than thorough smog check stations. If your friendly local smog guy gets too many failures he can loose his license.

I wouldn't worry about it with a Texas license plate. You also don't need a California divers license. Keep you Texas license up to date.

Here in San Diego there are random road side inspections events. These are fairly rare, I've been pulled over once in 40 years of driving. I'm not sure how they handle out of state cars but if you are missing obvious federal related emissions equipment you'll get written up. On the other hand, if you are pulled over for "Exhibition of Speed"...
California Vehicle Code 23109(c), it is illegal for you to accelerate or drive at a rate of speed that is dangerous and unsafe in order to show off or make an impression on someone else.
You can expect your car to be thoroughly gone over for safety and emissions violations regardless of what state your car is registered in. The officers have the authority to impound your car if they deem it necessary for the health and safety of the public.

And as far as CVC 23109(c) is concerned and for the officer to look under your hood two things are required: a warrant or reasonable suspicion the car is modified. Going fast, revving your engine, performing a burnout is not justification enough for modification/compliance check. Sure they will tell you that it is cause and they WILL pop your hood. But when you go into court and actually state that you did not consent a search then it becomes a question of legality that the judge has to weigh in on. BTW an inspection for the sole purpose of finding an infraction, constitutes a search. And if that search was denied well...
I'm not just being an internet lawyer for the sake of it as I've actually have won that exact fight. It wasn't fun, and it wasn't pretty, and I never want to go through that again but ultimately the law sided with me.
And agreed that this is all a moot point with regards to the thread starter given that by having his car not registered in CA allows the car to be non-compliant (exempt) with our smog standards.

I was stationed at mountain home, ID and just kept my registration in Texas, fwiw. They gave me crap about it but never a ticket. Apparently "other" states require you to have a registration form? We just have the sticker here and they found it hard to believe when I told them that
