Diff whining on decel after install by shop

Looking for some clarity here.

I just had rx8 4.44 ring and pinion swapped by a 4x4 shop and then installed on my car. Now it is whining on decel and the shop is not assuming liability.

I provided them with a complete rx8 differential in the housing and a rx7 housing with the differential and all its parts minus the 3.9 ring and pinion with bearings that I removed.

All parts were in good used condition and I gave them new seals, pinion nut and crush sleeve.

They told me they were able to get a good print on it.

Once installed it was whining during decel on my drive home and has not been driven since.

Should the shop have been able to get the differential assembled and functioning properly with the parts I provided them?

After the fact that it was already assembled they told me that because the bearings were used there would be no warranty for bearing failure. At no time was there a disclaimer that there could be issues with the parts I provided.

Please let me know your thoughts.

Brand new oem mounts with an HPP 2in1 brace and mobile1 75W-90 gear oil.

Remove the brace and see if it still whines.

The previous differential was installed with the brace with no issues.

I believe the whining is coming from improper lash and tooth contact.

That would be my guess. I'd maybe take them for a ride and let them hear it. You may have to work with them to resolve it, maybe pay for half labor or something if they're being obstinate. Or try another shop.

Thanks Dale.

I have already talked to another shop. They said if it is whining it won't likely go away with adjustment now meaning it is damaged.

I will just get another one and have a different shop install it.
