Twin scroll flap stuck.

So today when I was taking out the old turbo to build a hybrid I found that the twin scroll flap in the manifold was in the full open position. I would assume it should be closed considering it's only open after 2700 rpms. So is it stuck? Should it be in the full open position when the motors off and everything's disconnected? If it is stuck then how do I fix it?

And the flap itself is fairly loose and has a lot of play

with the engine not running, the valve will be open, since it's held shut by engine vacuum

Okay. Also while I'm at it. Are there any other mods I could do to the exhaust side of things. I just built a v trim hybrid and ported the Watergate. Would porting the smaller of the two intake runners do anything?
