HELP!!! if it is fraud, what can I do?

hi, this guy from other state in the forum bought my car. we both signed contract paper, and he paid me the depsit. then I shipped the car to him. and he was surpposed to pay me the rest and I will give him the title, and the deal is closed.

but after the guy received my car, I heard nothing from him at all, except one email said that he got the car, need to work on insurance now. but he doesn't even have title, and register the car yet. and he is not responding to all my emails, phone call.

maybe the guy is too busy to reply? I doubt it. if that is a fraud, what can I do? this guy is from out of state.

If he doesn't have the title your in good shape. If he doesn't respond to any form of communication in a due amount of time, you could basically consider it grand theft auto.

Technically the car is still yours since you have the title and he did not pay the agreed amount that was on the contract so get in touch with a lawyer and the police and sue him for the money he owes you for breach of contract

thanks for all your comments. according to our contract(I wrote it), he should pay me the rest within 5 business day. this is the 2nd day.

if the worst thing happens, should I just report to the police here or the police there?

Give him the 5 days you contracted for. If nothing in the 5 days then take legal action.

OH from what you posted you made it seem like its been 2 weeks since he took delivery and hasnt payed you give him some time to transfer/mail funds then worry about it. You should have made him pay upfront from the beginning tho befor you shipped the car. That would have solved any headaches befor they started

yah, I should have him pay me full amount before I shipped the car. but I was trying to make it fair to both buyer and seller, cuz I am honest.

I will give him some times to get the money transfer. but at least, he or his friend should have responded to my message. but I called them in different time frame, like even in midnight, still no answer. I left voice message, but no call back. I emailed him, and PMed him, he just replied once, said that he got the car. that was it.

that is why it makes me really nervous. I just smell something here. ;-(

Due to my website I have a bit of experience with this. Give the guy some time.. If you said 5 business days in the contract then give him 5 business days.

On the 6th day.. then you can begin to get worried. Luckily the law is completely on your side. In almost every state that I know of it takes weeks or months to get a "lost title" or a mechanics lean against a vehicle so the odds of him coming up with a challengin title is a long shot right now.

Once the 5th day has passed I suggest you write him a letter requesting payment and send this via certified mail. It does not take a lawyer to write this kind of letter. Just make it stern and request the money for the car. It should NOT be a threatening letter, so not mention legal or physical action. Be sure to include the cars VIN number and the dates of the contract. And keep a copy for yourself.

Something like this:
This letter is a request for payment for XXX car VIN:#### delivered to HIS NAME on MM-DD-YYYY per the contact entered on MM-DD-YYYY. The payment deadline passed on MM-DD-YYYY. Please send payment immedietly to ...YourAddress...

After you have a receipt of delivery from the USPS give him another day or two to make payment then contact your local police department and file a stolen vehilce report. Be sure to have all your paperwork handy showing the steps you have taken to get your money.

hi, guy, thanks for all the suggestions.
just a update for you all. I just heard back from this guy last night. and he promised to call me tonight to talk about the payment. I will see how it goes.

maybe I was overworried. but that really caught my nervous when I lost contact with him and his friend for 3 days.
