I'm curious as to where you think the air comes from. Rotaman is half right in that while it's not coming from the engine bay, it is essentially leaking into the area where the stock intake is located from the multitude of openings to outside. Common sense really.
Is there a gasket between the inlet of the snorkle and the engine bay ? If so I don't have one but if not I would think it would get some of the air from there.

There's a rubber seal on the underside of the hood that separates the intake from the engine bay.

Is there any information of aerodynamic flow on convertibles? The duckbill spoiler was the only one that didn't create drag, but would that also be true if the spoiler was put on a convertible?

I've never seen one, but here's one from a Miata to at least give a vague idea of what it'll look like.
