State referee

I got pulled over yesterday by a chp officer and was reffered to the state referee. The asshole pulled me over because of my exhaust and no front plate, then he asked me to pop open my hood. In the end he gave me 5 citations and said that none were correctable infractions. He took pictures of my engine bay, he even thought i had nos so he took pictures of what he thought was nos, and he took my picture. He told me to go straight home and that he didnt want to see me driving again or else he would do the same.

My main question is there anyway out of seeing the state referee or do i have to put my car back to stock?

iLikeEatPoo 03-14-08 02:50 PM

what do you have in your car that is possibly illegal? my auntie got pulled over in her turbo civic but the cop thought ALL TURBOS WERE ILLEGAL but it was smog legal. I mean how could it not be since she been smoging that car here since she came from VA 4 years back. also I think nos ain't illegal to have just illegal to use on the streets.

windchaserfc3s 03-14-08 03:18 PM

Go see a judge and ask to pay it off. Its going to be like $500.

1revn3rdgen 03-14-08 03:34 PM

Damn i have to pay $500? Im sure its going to be more since i also got citied for not having my drivers license on me and no front plate. Anyway i guess its better then putting it all back it stock, the car doesn't pass smog in the stock form either because of the port job.

AcidAngel7477 03-14-08 05:53 PM

soo..what's so not stock on your car other then the port work?

:AA:

LSD-Ryu 03-14-08 05:57 PM

You shoulda refused to the popping of the hood. He'll try the "Reasonable suspicion" bullshit, but I don't let anyone go under my hood unless they have a paper saying so.

AndrewAmazed 03-14-08 05:58 PM

wait...
srry if im wrong but, isnt technically "only" oem parts legal, and any aftermarket parts actually count as illegal? but im not to sure about that...

gl with the case and yea

 Would be nice if you LET US know what you got a ticket for....

other then what you just mentioned ..

after he popped the hood

what did he say was "illegal"
??????????????????????????

Having no front plate is only $30. $50 if you wait too long.

Any aftermarket intake/exhaust/turbo parts must be CARB certified to be legal. There should be a CARB number on the part, and carrying around paperwork may help too. But you can often get away with intakes and catalytic converters that aren't CARB legal. For the intake they often let it slide because intakes can't leak pollutants. For the cat they let it go b/c either they can't tell the difference or don't mind as long as you pass the sniffer. And b/c there is no CARB legal aftermarket cat. For other stuff, if it's not CARB certified it may leak exhaust which won't show up on the sniffer. So yes it's illegal and yes it matters. Noise is an issue too. Plus you can get a mean cop, who may be more strict or try to cite you for things that are technically legal. Like noise that's loud but still below 90 dB.

I have a gt40r turbo kit, upgraded fuel system, no cats, v mount intercooler, ignition, and ems.

I wanted to refuse but i thought that i had to open it no matter what.

I got a ticket for no front plate, modified exhaust/loud, modified emissions system, nott having my drivers license on me, and no having my proof of insurence. He said that it doesnt matter if i do have them, but because i wasnt carrying them, he was going to cite me and that it was non correctable.

I paid for a no front plate ticket about 2 months ago and it was about $140.

socalrotor 03-14-08 08:08 PM

If you refuse, can't the man just impound it?

magus2222 03-14-08 08:09 PM

holy shit. fuck so cal. in norcal where i live, i got pulled over 45 times in the year 1/2 i owned and drove my car.
total tickets.........3 speeding, 2 fix its (front plate and expired tags)
damn, sucks that down in socal their getting mean about cars and modding. hell, the state has tried 10 different times to ban modding of cars period.
its a dictatorship i tell you

socalrotor 03-14-08 08:14 PM

welcome to C.A.R.B. it will get ya sooner or later.

1revn3rdgen 03-14-08 08:20 PM

Yeah i thought they could impound your car if you refuse.

This is only my 3rd time in the 7 years i have owned my car, that i have got pulled over in my car, and its the first time they tell my to pop my hood. The other times was for my front plate but never for my exhaust not even when i drove next to a cop have they tryed to pull me over. Yesterday i was stuck in traffic and the chp officer just got on the freeway and went straight for me.

silentblu 03-14-08 09:49 PM

damn tom, good to hear you got the car going again, but shit that sucks

nukeall 03-14-08 10:03 PM

$500? year right!
If you put everything back to stock, the judge will *probably* wave the fines, even though it's non correctable.
But if you just pay the fines, it'll probably be $1500-$2k ish.

Your aunt drives a Turbo Civic? :crzyeye:

OP: sounds like you get it up the ass, try this: http://www.ticketassassin.com/shareware.html

And Steve made a good point, if the cop really wanted to be an ass, he could've just impounded your car just like that. And where the hell is Fumanchu?

I got pulled over by the CHP back in November for modified exhaust, he looked under the hood and everything and let me go.
He asked what I had modified under the hood and I told him just intercooler and intake and he asked to look under the hood and I figured I'm screwed at this point.
He had his head buried in my engine bay he even looked right at my NX nitrous solenoid.
I have the Greddy intake, V-mount intercooler set-up no smog equipment etc.... I think he didn't know what he was looking at maybe thought I would pop the hood and there would be a 4 cyl motor.

I was sitting in a race seat with 4 point harness, steering wheel with no airbag, no front plate (which he couldn't have missed looking right at the front of my car). He told me he's not going to write me up but do something to make my exhaust more quiet.

I thought for sure I was getting the Ref Ticket, I have no tickets on my DMV record and was very polite maybe thats why I got off with a warning.

magus2222 03-15-08 03:46 AM

you know, in my 45 experiences, some cops are nice, most are assholes. sometimes you have to play their game, sometimes a finger works too.
straight up told a cop "ok, so what? do you have a db meter on you? then goodbye" he got in his car all pissed off and left.

peace

Im speaking from experience....but then again I dont know how much worse this stuff got from the new year...

Siraniko 03-15-08 08:37 AM

Glad to be a member of the biggest gang. Law enforcement. No need to worry about them plus i have a fake hood prop. aint opening the hood for no body...that will give me time to :)

ePH C freak 03-15-08 09:47 AM

"if you can't beat em, join em!"

my cousin got popped for having ITB's and no cat on his EG6... it was indeed a REF ticket and all he did was pay a fine... didn't convert back to stock or anything... although he ended up selling the car because he felt it was "marked" and that he could get cited all over again by an officer who'll run his plates...

another friend of mines has an AE86... he got 2 ref tickets in 2007. he said each ticket was around the $450 mark. i seriously thought the fine would INCREASE if caught repeatedly :dunno:

California smog laws SUCK!! i see truckers dump nasty black smoke into the atmosphere all the time!! My car hardly ever does that  Cali's pretty much known to be the strictest of all states when it comes to smog, and i can't UNDERSTAND THAT when i look outside towards downtown or at the mountains and see the "brown air". what's the point of all these smog laws? if you ask me, it's $$$$$$ :icon_tdow

Siraniko 03-15-08 10:21 AM

I can smell the price on old school smog exempt cars going up :icon_tup:
