Stolen Car (Please read)
Hey guys.
As some of you know already, I recently "sold" my car. The buyer is halfway through paying the full amount, But has been very flaky (trying to get out of paying the monthly payments on time) (btw i still hold the title under my name)
Every month on the 13th the payment is due, until the car is fully payed off.. We had it all Notarized at the bank.
Well He calls me on the DAY the payment is due and says he doesn't have the full amount. (He did this the last couple months as well)
So i tell him to bring the vehicle to me for a couple days at least until he can finish paying off this months payment.
He hands the phone over to his dad who starts going psycho on the phone screeching and yelling at me. I couldn't even get a word in.
I hung up.
I haven't received any calls back from Cody. Or his dad (david Agust) (not that it's his business anyways, Contract is set up with cody, not his dad.)
I did call back later to speak with Cody, to see if we could work something out. But he never answered.
I wanted to let you all know whats going on. I hope that you guys can keep your eyes open for my car.
It's a very clean (i hope it sill is anyways) red S5 rx7. with blingy wheels (lol)
racing beat exhaust.. It's a nice car can't miss it.
As of today the car is illegally in his hands. I hope it doesn't come to this, but I will be filing a stolen vehicle report shortly.

If someone can't afford to buy a 2nd gen, then they don't deserve to buy it. I'm sorry you are in this situation, sucks ***. Good luck though man, if they don't pay up, call the authorities, you do have the contract.

where's this guy live? for a fee, I could come "reposess" the car and deliver it back to you. Oregon, right? I go to Washington state all the time anyway, so it's not too far out of my way. lemme know.

ty for all your replies. :-) Yes i have the contract in a safe place, i have already contacted the police.
Also, the plates are different , not RX7GRL anymore.
He lives in vancouver.

So you agreed on a "payment plan" for an individual buyer?
WHY do people do this to themselves? WHY are you trying to bear any financial risk in case something goes wrong (like in this case)?

If you can find the car, all you have to do is take a trailer or a towtruck, or even a spare key (I hope you were that smart) and go get it. I have done this before myself, as long as the title lein is in your name, it is legally yours.
one piece of advice though--if you do that to get the car back, be sure to secure it in a place where he could not take his key and steal the car back. Sad to say but these days you seriously dont know what some people will do....
Maybe the wisest thing you can do at this point would be to contact police. You can have an officer come to your house, explain whats happened, and ask them to accompany you to his house to retrieve the car. If he resists, the cop can inform him that you reported it stolen. A tip, though--if you do this, you need to have reported it stolen first, because the police will likely consider it a civil matter if you dont. Best of luck and keep us informed....

Man that sux! Hope you get it all sorted out. If you call the cops and give the cops the story and the address I'm sure they can make that money the boy "didn't have" some how magically appear.

translation: he reads the forum and I hope this scares him into making the payments.
There might be another issue here re: getting the police involved:
Vancouver is across the river from Portland, but in Washington state. Can Oregon cops work in that jurisdiction?
Also, if the car is in your name, and he wipes out a family while driving drunk or irresponsibly, can you be held liable in any way?
Best to simply repossess the car until he coughs up the entire balance owing. Here's hoping this mess works itself out for you.

Thats a GOOD idea, I don't want this to turn into a gunfight, but you never know. I mean, if this guy isn't going to finish payments, and you THOUGHT he was your friend, you never know what this guy could do, I mean look at what his father did to you, he cussed you out over the phone, even after you let them make payments. Stay protected. Get the authorities involved, in both states if necessary, and bring along some men, not boys.
No offense, but some people will try to take advantage of others because they're females, so be safe.
