Does anyone have any contact with Jsplit aka John Edmunds from Crofton MD?
 
I hate posting this, but it was been many months now.

Long story short, I took 3 weekends of time to drive down to crofton MD and pull his motor, tear it down, build up the reman, and reinstall it. I originally quoted him $900 for all of this (a killer deal considering I was driving to his location, and bringing all my tools and engine puller). By the end of the ordeal, I ended up telling him to just pay me half ($450) because he was a nice guy and because he helped out with the process, to include some of the final details needed to get the car running.

Right now I am actually losing money on this because of tolls paid out and because I had to purchase many tools specifically for this job that I won't use again until my motor goes.

Maybe I'm a sucker or just too nice of a guy, but I trusted him and didnt ask for a penny up front. Now he won't return any of my calls to his cell or home and won't return emails or PMs. Basically, he's avoiding me. Can anyone help with this situation? I really dont want to drive down there to discuss this with him in person, but it looks like it may have to come to that.

With me doing a bunch of the legwork and you never completing the job. You got the engine in the car but made me wait almost a month before you could come back to finish.

Some of the final details? There were a ton. Downpipe wasn't on, vacuum lines were not done right, oil lines not secured, bolts not tight etc.

Months ago I told you shit was fucked and still offered to pay for your gas and tolls because that was an actual expense ( nevermind the fact that with your job you wrote all this stuff off because you drove your company car down ) so you'd be getting paid twice on the gas but that's cool.

And that's just the 1/2 of it really. I had a major exhaust leak that PFS had to fix. Then the first time out at the track my brand new clutch is slipping like a bitch. So when me and Ryan decide to swap that out we come to find that 1/2 of the pressure plate bolts are just hand tight...

I could go on and on about this stuff, bottom line is that while you spent time and did hard work, the job wasn't finished and what was done wasn't done properly so I had to spend more money to get things corrected the right way.

Finally, I gave you a place to sleep, food, tons of alcohol for you, your brother and your friend at times. I let you take my RX-8 to MIR when you drove your FD down because you didn't wanna drive it down there.

No one is debating that you're a nice guy or not but seriously there was a lot of shady shit you did late night including throwing a shoe at my friend Jen's head...

I don't know where you're calling, nor who you're leaving PM's for but it isn't me.

I am not getting into a pissing match with you, but I have left numerous messages (over 15! just left another one) on your cell # you listed above, and also on your home phone #, which I won't post publicly. I have also replied back to an email you sent me.

Come to find out I am not getting compensated on any tolls or for personal gas charges, but that is beside the point. We agreed on a price, which was $900, and given all the extenuating circumstances, *we agreed* on $450, which I thought was pretty damn fair given the situation.

I PMed you my mailing address so you can send the check again (the first time it got lost in the mail, right?) and this subject can be over for good. From now on please converse over PM and I'll do the same.

I didn't get to my phone in time and quite frankly I have no desire to get in a screaming match with you over the phone. Email me or PM me, much more relaxed for both of us.

Unless there's some magical contract that you have which I signed, I don't owe you anything for a job that wasn't finished or done correctly for that matter. However, I've offered and continue to offer to pay you for gas and tolls, which is more than generous. You don't see me charging you for room / board / booze or for the drive I made up to NJ and back because you forgot one of my parts.

It doesn't matter who you are from a shop to an individual if you don't complete a job correct you don't get paid. It's simple really.

Not to play Jons advocate but Ryan and myself spent an entire day getting Jons car finished off. It's not as though the job was "almost done" or anything. We also spent some time re-doing some of the work that was started by someone.

Rich you say that you guys agreed on a price but I would also imagine that the agreement was with the understanding that the job would be completed before any money was exchanged. Personally I would not expect to pay anyone for a job that was never completed. You snooze you loose. Thats my opinion on the matter. I would also not expect to be compensated on gas considering he housed and feed you during your stay and you never collected money for gas before driving home. My advice would be next time you choose to drive cross state to help someone out on a job. First off be prepaired with a contract of service and secondly get a deposit on the work. Lat but not least, be expected to finish the job before you start handing in a bill.

Hopefully you guys can get it straight then kiss and make up.


Jon on a side note your parts are almost done. Pay me now :P

Unfortunately any verbal contract under 500$ is binding, wither or not the work has been performed. (even more if you actually shook hands on it) Not that I need to get involved, I’ve helped quite a few FD owners and never asked for a dime, but that’s me, I also would NEVER stiff a man who went out of his way to help me no matter how good/bad of a job he did. Wither its 900-400 of just the tolls, gas and labor it’s still the principal he drove all the way down there to help you, whatever you gave him there is just called HOSPITALITY, which I think anyone of us would extend to another owner who was helping us.

Ok back to being quiet ;)

That may be true in Jersey. I do not claim to know New Jersery laws. I do have serious doubts if that is the case in Maryland.

I'm surprised you would do this to a well known member of the rotary community.

You can knitpick as much as you want, but can you deny that (after spending three weekends driving over 500 miles roundtrip to work in your garage) i spent many hours of my time pulling your engine, tearing it down to the block, opening the block, inspecting the internals, making recommendations, building back up the reman, and getting the motor back in the car?

surely this is worth more than the zero dollars I've been paid.

What's the deal John? Be a man and settle up your debts.

Im gonna throw my opinion in and some facts. One, my uncle owns his own law firm in Maryland and a verbal contract IS leagally binding. Two, regardless this is plain wrong. If a guy that you don't know is coming 500 MILES to help you pull your motor, regardless if it was totally finished or not, YOU OWE THIS GUY SOME MONEY! This is a dick move, no way around it. Its apparent that Rich realized he didn't do all that was originally planed or else he wouldn't have dropped the "AGREED" upon price by half. And to split the difference would be pretty stand up, even if you have a beef with how much he did. Regardless, the guy spent alot of his time and money helping you. YOU OWE HIM THAT MUCH.

Damn. If someone helped me out, I'd pay him (in small unmarked bills that the IRS doesn't need to know an thing about) even if it was just accross town.

I don't know the facts, but it's a sad day when on rotory own sticks it to another.
