Drunk hit my Chrysler

This guy clips a parked car and knocks his from right wheel out 100 yards from my house. He then bounces off the sidewalk where the wheel comes completely off and comes to rest 50 yards from my house. He continues to drive where he sideswipes my neighbour's parked car behind mine before he sideswipes mine from quarter panel to front (wrap around) bumber where his Explorer finally dies. I assume that the fuel cut-off kicked in on the initial impact because he couldn't start it up afterwards. Yes, he was trying to get away on 3 wheels!

I call the cops who arrest him within 2 minutes of talking to him for driving under the influence. Unfortunately for me he cannot produce proof of insurance, at that time, so it looks as if I have to pay the $300 deductible but on the up side he gets hit with driving without insurance.

And that's what happened to me last night!

Oh good its not your 7.

Secondly, I smell a lawsuit coming on...........Can you say 3rd Gen with settlement money?

Dom 04-18-05 12:47 PM

Wow, I can be reimbursed for my loses beyond the deductible?

So, looks like I'll be needing $25k plus lawyer fees...

;)

Here's some Irony - Isn't that a M.A.D.D. ribbon on his antenna? lol

You should be able to sue him for the cost of your repairs, legal fees, and rental car while yours is in the shop. Basically everything his insurance would have paid had he had it! Look into that!

Shit, that is a MADD ribbon!!

My insurance covers my repairs and the rental short of the $300 deductible. I'll be calling the police to check on his insurance. Seeing that his truck looked just about new, I am betting that he does have insurance. And since the onus is on him to provide proof the cops just charged him to give him some incentive, I think.

Leigh Adams 04-18-05 02:06 PM

that MADD ribbon means nothing to a drunk father ;)

LOL I thought it was! What a clown...

If you can avoid having to use your insurance, all the better. My car was hit by a plow while in my driveway - caused $1700 in damage. The plow company went bankrupt 2 days later, and my insurance had to pay. The called it no-fault and I didn't even have to pay the deductable and my rates didn't go up.

Of all the things I hate (and I hate a lot of things) drunk drivers are at the top.

In fact, they really do kill other people more often than themselves - their relaxed state, and the fact they often t-bone other cars running lights/stops, means they on the whole give worse than they get.

soulja77 04-18-05 06:39 PM

he definitely has insurance... everything will be covered. Go get yourself a 3rd gen :)

He didn't stumble around or slur his speach. And his wheel didn't fall off, it was torn off after the second hit. That second hit on the curb took a chunk of concrete!

His judgement was definately not up to par since he was sitting in his 3 wheel, lopsided sportcute trying to start it up, so that he could grind his getaway in a shower of sparks!

Sounds funny coming from a Texan after seeing a picture in the paper of Greg Biffle with 2 six shooters celebrating his win in Texas. Maybe using rope has to do with enjoying the moment a bit longer, sort off like longer lasting gum, maybe.

Your driveway is private property and the rules change at that point. Mine was parked on a public street to avoid the bird poop from the birds in the tree next to my driveway. The good news is that I don't have any bird poop on my car but on the other hand I have $3500 damage to the left side of the car.

The deductible was covered by the plow company's insurance I would think just like mine will be when I call the cops tomorrow to get his insurance specifics.

Snrub 04-19-05 12:32 PM

Sorry about your Chrysler.

Nice catch spotting the MADD ribbon!

Dom 04-19-05 01:37 PM

Just got off the phone with the cop shop and he does have insurance.

So I have no out of pocket expenses, just the inconvenience of taken my car to the body shop. The loaner I have is a similar model to mine so my 4 year old's booster seat fits without adjustment and I know where all the knobs and buttons are without having to take my eyes off the road. On the other hand, I can't find it after work at night because it's the wrong colour!

Experience shopping for quotes have shown that they are all the same except for Maaco which is always cheapest. And going to the most expensive shop only hurts all the regular shmucks' insurance premiums. I went back to Windsor Bodyworks as I've done the last 2 times for this car.

It happened near Tecumseh Road and Pillette. Pm sent.

err yah, I guess that would only be a good thing to do if they were paying. :)

Okay, that wasn't clear. People's injuries in auto accidents are often made more severe when they see it coming and brace for impact, especially head and neck injuries. This is because while you can brace your feet against the floor and your arms against the wheel or dash, this just leaves your head as the first thing that's going to move - hence more severe/deadly head and neck injuries. Been there, done that - both ways. In two separate nearly head on collisions. In the first, I never saw it coming, but my neck injuries were less severe than the 2nd, even though the car that hit me was travelling more than 2x as fast in the first incident, and I was driven backwards 25m from the point of impact. In the 2nd, I saw it coming and braced against the wheel - with the result my head snapped worse, and I needed months of physio. In the case of the drunk, they're not reacting well at all (if he was, he might have avoided the accident) - he's more of a rag doll at the moment of impact, and ironically, this helps the drunk be less likely to be, or less severely, injured.
Less weird?

I'm not usually very litigious, but I would seriously considering suing. This guy needs to be punished.

Suing him for what?

The hour or two spent taking my car in and getting a loaner. That's all I've lost. The insurance pays for the repairs and loaner.

This guy done some major, at fault damage to his own sportcute and has been charged for impaired driving. I think the insurance company have found themself a new b*tch for the next 7 years (?). On top of that, he spent the night in jail and now has a trial date which he isn't going to beat.

The only satisfaction I could have had passed when the cop arrived before I realized that if this would have happened during the day, my kids would have been outside.
