buying a car but the previous owner didnt register it yet
 

well i am buying a car but the guy im buying it off of didnt register it yet, the owner before him sold it to him but he never drove it, and now his name is on the ( the thing that the seller and buyer sign ) is there a way to register it into my name .... if not im going to get my deposit back because he didnt tell me until today ....

Couldnt you just have him register it in his name then he'll have ownership. Then you take that owenership with the same section filled out?

yes, he may have to pay late fees ( i dont know if any apply in the MTO of ontario ) .... hopefully he goes through with it, its a nice car for a good price .... i told him he has to come clear this up the same day before i purchase the car ....

sign a declaration of ownership at the registries.=. you swear under oath that you are the proper owner of the car. just make sure the retarded clerk copies the vin number correctly and isn't trying to register a car from a few provinces over as yours.

its fine, as long as you and the current owner(the guy your buying it off of) both have a copy of a signed piece of paper that states that he sold the car to you. just show that to the mto and it should be fine, also i dont think we have "late fees" when i bought my gxl i had it for almolst a year befor i finaly registered it. just make sure that the paper has both of your names and signatures on it.

hopefully its as easy as that :P i kind of scared the guy by saying about the fees lol ... and he cant back out and not sell me the car since he signed a paper stating the deposit and the final price .... we will see next weekend but ill call him in the morning.

DONT BUY IT! Dont pay a cent until the person you are buying the car from completes all the necessary paperwork from the previous owner. I have been in the car business for 27 years and I am telling you something isnt right. We call people who do this curbsiders, and that is how they get around the transfer laws etc. You are only allowed to buy/sell 5 cars per year and these guys do 5+ cars per month this way. If there are liens etc you will be the one stuck holding the bag. If you ahve any issues with deposit money you have paid just give OMVIC a call and they will help you.

wouldent the used vehical information package clear that up? and if not, by law dont you have the rights to know such information being the potential buyer? in the same way you can find out anything under the freedom of information act (i think thats what its called) i know that works with buissnesses and a car sale is a legal transaction between the buyer and seller.

yea, i called and said that he either has to get the mechanic to sell me the car and sign a new thing, or he registers it, pays the charge and taxes, then sells it to me. if he cant find the mechanic or does not want to register it in his name im definatly getting my money back ....


also im not giving him the rest of the money until this is cleared up.

get the car in the seller's name first,,then buy it.
Btw: a deposit is usually forfeited if the deal does not go through.you may wanna talk that over with the seller.

if he doesnt sell it ill just bring up he did something illegal that he is trying to sell a car that does not belong to him. i didnt know until after i left. most times people follow through when legal problems might occur

Like I said in a previous post, if you want to resolve this quickly get the Ontario Motor Vehicle Industry Council (OMVIC) involved it will be solved in a hurry.

Listen to Alan he is experienced and wise in these matters.
Demand your deposit back and do what Alan said. Call OMVIC or PM me your details as I know someone who works for OMVIC and they would be very interested in this kind of transaction.
Of course he wouldn't have mentioned anything about an issue with the ownership till he saw that SOLD sign in your eyes. He is 99.9 % likely to be a Curber.

well we talked and he is going to get the mechanic to buy the UVIP and an un signed registration/bill of sale also so i just fill in the date and i sign when i go transfer it over ... luckily the mechanic didnt skip town :P

You are setting yourself up for failure, your dealing with a curbsider.

Why won't people listen to Al? He knows what he is talking about after dealing with thousands of car sales over the last few decades. Unless the car has clear title and you are buying it from the owner, he more than likely is a curbsider.

The whole thing about the mechanic buying and registering the car seems really really fishy to me and you are walking into trouble with open arms. No car deal is worth major hassles. Walk away, get your deposit back and go to OMVIC.

I agree. The other thing to consider is that the car may be unregisterable. When I bought my FD, the MTO wanted a structural safety done before i could register it since I bought it from the states and it was 'unbranded'. It hadn't been hit, the car is pristine, but all the same i had to jump through the hoops.

is it possible that it is registered as a salvage or irreparable brand and that's why he has not changed the registration? Did he even show you the ownership?

go to the MTO with the ownership and tell them that. they'll transfer it into your name same as usual. It's not a big deal. I've probably done it a dozen times. It's not really a big deal and happens all the time with "projects".

I don't think curbsiders deal with 20+ year old cars that often.

Or, make him put it in his name and then buy it. This will cost him money and he may not be willing, but if you tell him you won't buy it otherwise I'm sure he'll do it. Or make him come to the MTO with you.

What's retarded is if it's over 20 years old it'll need TWO appraisals just incase the value changed during the 5 minutes you were in the office. )(*#$ money grab.

the mechanics wife owned the car, he is showing me the Used vehicle info package before i buy it and then he is coming with me to the MTO place to register it in my name. if it doesnt work out at the MTO or the Package shows shit thats owed on the car or its "wrecked" ill get my money back
