The timeframe is not all that importnt to me. I would like to get my car looking like it did, but (and not to say a bad word on this forum), I do have a 91 Accord that I replaced the enginein in case of a rainy day.... No matter if it's a Pinto, it's nice to have something else around, I learned that affter my car was parked for 5 months while I gathered the funds to fix it. Any way, I am a Developer on layoff, so I'm not doing much these days but living off of unemployment and searching for a job in the, what seems like, dead market.

My friend did tell the cop about the guy looking right at us when he hit, but the cop said my friend was a "biased" witness. The insurance company said the same thing. But, like I said, if it can be proven that he did do this on purpose the insurance wouldn't be covering it to begin with.

I am not taking the fact that he did this on purpose "lightly". But getting my car fixed is my #1 priority. I'm not a small guy. When the wreck happened I was screaming at him and standing nose to nose with him. The guy got scared (litteraly, he was shaking) and got back in his truck and called the cops. I figure he learned his lesson and not all cars like ours have little high school punks behind the wheel. If my friend wasn't there to restrain me I would probably be in jail on assualt charges right now.

But if I cannot get justice through the insurance company, then I will be seeking damages from him through the court systems. I mean, the court systems still wrok, right????

That sucks. Sorry to hear. Why don't ya just get another blown motor chassis and swap everything over?

Back in December of 2000 I was involved in a car accident that broke my back, skepula, ribs, etc.
But anyway anyother jeep ran into the back of my jeep going about 35-40 mph and it almost totoalled my jeep.
And I'm still waiting for a settlement from that. Im wondering how much I will get from this, any ideas.
I will never be 100% better.
When I get that settlement I am going to get me another Rx7.

Cipher, I noticed that you are located in Houston, I am in Austin. Anything like that (intentional ramming) would land that redneck in jail in 2 seconds. You should get a lawyer to handle your insurance issues. You should also SUE THE SHIT OUT OF THAT GUY!!!!!! You have one witness, with that and a lawyer you basically insure your chances of winning in court , especially here in texas. Im not sure about houston, but in austin and surrounding counties there is a 0 tolerance policy for drunk and RECKLESS driving, if he rammed you in the fashion that you claimed, that is ATTEMPTED MANSLAUGHTER as well. Dont quit until this guy is eating from a dumpster and living in a cardboard box

sometimes you can get more money from sueing (sp?) than insurance. get a lawyer, and see which you can get more money from. if you find out you can get more sueing, make sure to go to some acting classes :)

Hell yeah, get yourself a lawyer!!! I agree though that your friend would not make a credible witness. Not only because he is your friend but because he is also a possible plaintiff against this guy. You can both sue him in civil court but it would be up to a judge if he/she believed you.

one thing to remember. this guy likely has a history of reckless driving that will only help your case. idiots like that probly do it for fun and laugh about it with thier buddies afterwards while drinking beers......

needless to to say hes probly a drunk driver too.....

Yeah, I've tlked to one, but he suggested before shelling out the cash to see what the insurance company wants to do. They are still trying to get ahold of the guy who hit me - apparently he's not wanting to call them back.

He suggested I tell them to contact him AFTER they tell me they're gonna total the car. At that point I will have a pretty good shot of having them pay for his bill also.

There is a law in Texas stating that we cannot sue the insurance company, however we can go to court (medation court????) to pursuede the insurance company.

I do have a line on another car - AND a 4x4 lifted Blazer both for under 4K. These will be my new toys if they take the high road.

The 4x4 in case you're wondering is because I like to fish (salt water) and hunt, so this will be a play toy.... Something to ride the dunes in......
