Check Engine light problem

So my check engine light only comes on when the car is in the on position when the engine is cold. if its been sitting in the sun or the engine is at normal temp it wont come on. any ideas why? PLEASE HELP!! I need to smog it and this is keeping me from doing that. THANKS!!
