Need Your advice 3rd Gen Tranny sale gone sour

I sold a 1993 tranny to a forum member here on this forum. The tranny came from a rolled chassie that i had previously drove in with the owner about two weeks prior.
The original owner of the car was not a go fast guy and always babied and granny shiffted the car. Took really well of it.
Anyways two weeks later he told me the car rolled and that he just claimed it on his insurance. He asked if i wanted it for parts I said yes. I took the car and parted it out.
A forum member hits me up asking me about the tranny. Asked if i still had it. I said yes. He told me how much I said 400 and i deliever it to you. He said $300 I said okay. I drove to L.A dropped the tranny off on june 24th 2007. Three weeks later from that date today on july 16 2007 he tell me that the tranny chatters in neutral, shifter gets stuck going side to side.
When i had dropped the tranny off he showed me the car its a 1979 with turbo motor, turbo upgrade, and a beefy 8.8 rear end.
He is now asking for his money back because the tranny is broke.
1.the tranny is used and i sold it as a honest sell telling him the history of the car and the tranny.
2.Why would he wait three weeks from the day i dropped it off to july 16 2007 tell me the tanny is no good
3.He now whats his money back
I said no, cause i don't know if he broke it or if it was broken in the first place which i highly doubt cause i had the tranny checked before i sold it. And i don't know if he drove the tranny hard, or draged raced on it till it broke.

The chattering could be the shifter he's using.
I called Ray several weeks ago when I was replacing my tranny and bought the fifth gear syncro. He also mentioned I should change another part on the tranny and I'm pretty sure he told me it was called the spindle select. That's what helps keep the shifter centered when in neutral. That could be causing his problems when shifting.
1. This is a risk a buyer makes when purchasing a used part. You were up front with him and he knew the risks. Honestly he'd be hard pressed to find a good tranny for less than $300. I paid $600 for my low mile JDM.
2. As far as waiting three weeks, well I have parts I bought over a year ago that I still haven't touched.
3. As for giving his money back, that's up to you. Its possible that in the roll over the driveline shocked the tranny hard enough to damage something, It's also possible the guys install was not correct or he's already tried launching with it and broke something. Either way it's a risk to buy from a wrecked vehicle and the buyer is responsible for deciding if the risks are worth it.
Ask Ray at Malloy for his opinion on why a shifter gets stuck going side to side or maybe someone else will post as to why.
Nobody likes to be out $300. If you feel the transaction was fair then explain this though PM with the buyer.

If you checked out the trans and know for a fact that it was good then I would just say "hey the transmission checked out fine before it was is in your hands, and it's a used part. How do I know that you did not do something to it?" That's what I would do...
Transmissions are always subject to the driver and to the load put on them. The fact that he fragged it is not your fault at all. If he had installed it in a stock car and the tranny locked up as he rolled it out of his garage, then that's different. I would try to find out if he put up with these symptoms for a while or if it was all immediate.
The wiggly shifter could be due to a spring that pushes against the shifter when it's in 1-2. The select spindle the others were talking about is what pushes against 5-R, and upgrading to a stiffer spindle helps avoid crunching 5th when aiming for 3rd.
Another possibility that would relate both of these is there was damage to the shifter gates and the tranny got put into 2 gears at once. That will instantly frag a tranny if the car is moving. Or the interlock pins were removed (sometimes happens accidentally when people are incorrectly filling it with oil). Ask him if he had trouble finding the filler plug, or if there were any bolts broken off of the center section of the tranny housing.
Finally, the tranny could have been racked (twisted) during the wreck. If the car just rolled over, I kinda doubt it. If the car hit anything hard, then the forces could have been transmitted thru the tranny and left it ever so slightly cockeyed.
It's possible to learn about what happened by opening it up and looking at the damage, but at some point it becomes more time intensive to investigate than it's worth.
I don't think you owe him anything. He bought a used tranny for a pretty good price. He knew it survived a rollover wreck, and that he was buying it from a seller who is not a transmission mechanic. If he himself didn't get it inspected by a tranny mechanic prior to installing it, then he took a risk and lost. If you are really concerned about your seller rep if this guy goes all wonky about it, you might consider a partial refund.

hey guys, I'm the forum member that he sold the transmission to. Just wanted to give you a little backround on the story here.
He posted a thread for 3rd gen parts for sale which at the time was convienient for me since my tranny was going out on me. I brought it up to him via pm that I was interested in the tranny that he had posted for 300, He replys with "400 brought to the door", Coming from san diego. I told him that i was going up there that weekend although he says that hes coming down for a LA BBQ so I told him I'd give him an extra 60 for gas totaling 360>
He gets to my pad and first thing I notice is gear oil spilling all over the bed of his truck & there was a mild to thick ( is some parts) coat of oil and residue on it. He had said he was going to clean it up for me before he got to me but it really didn't bother me. I've got a shack from Home Depot that the tranny was set in while waiting to be installed, where it never saw water or direct sunlight /not that it matters but just to let you know. 2 bottles of citrus de-greaser and a gold bristled golf club brush and it was as clean as I could get it.
NOw when he came to my house and helped me bring the tranny into my yard, I showed him the car that it was going in. He took the time to go around the car and he was impressed, I let him know that I, MySElf had built this car from the ground up and have had no substantial help from my parents or loans, or a shop such as 12 31, -------- and thats why it would take me some time to put in and finance the swap.
Fast Forward 3 weeks, ----- I finally get paid and I've got the cash to do the swap,While moving it from my house to the spot I notice debris in the shifter position and i extract 3 small rocks that I still have, and set in my bolts bucket since i was surprised that they would have been in there. I'm fingering around that same area and feel more Peices of something, (I can't tell because I can't get them OUt) which are floating around the shifter area, My mechanic says that it shouldn't affect it so we continue on.
Get the tranny bolted in and there's no problem with filling the oil or anything, It slapped right in (and being it's not the first 3rd gen tranny to go in, everything went smooth.) I"m running a short shifter from MazdaTrix and felt beautiful in my last tranny, but as soon as i'm wiggling the shifter in neutral from left to right, it's getting stuck right in back of 1st and 5th. NO retraction back to the center of neutral, it just gets stuck. Turning the car on a soft chatter is coming from the tranny, already by this point my heart has dropped knowing that this tranny is already going to *****.(I just went through it I SHOUD KNOW). The mechanic even said it didn't sound too promising. I took it for a test drive and all the gears go in and the car runs, but for how long. GOing into 4th gear at 2800--3000rpm it chatters and vibrates untill you get threw it.
WHat i want to know is how TEDDY checked the transmission? If I knew of a good way to check how good it was without putting it into a car I would have saved myself some time and done it before i put it in, --- The tranny was dirty enough to know that it had not been opened or internally checked, I just went on his word, and since his reputation on the FORUM is good, it was good enough for me.

He pm'd me again today and im not one to screw anyone over. When it come to selling parts im a upfront person, and describe each item or part to the fullest extent of there condition. And all the parts i sell are used items. The tranny was checked out before i sold it. I always fair on giving money back or partial money back if the shoes fits.
The cause of the accident was that severe to twist, interlock or damage any parts inside the tranny. When the car had flipped on it top side it stood like that, the car continued slide down hill till it stopped. But that was it. The pineapple racing motor was pulled from it, and was also tested and that motor turned out to be fine, and very good excellent condition.
The cars history is as follow before the accident. ALAWAYS garaged never driven. The orginal owner was an older military commander, who collected cars and a had a passion for the mazda's. It was just an unfortunate turn of events that took place on sunday evening when he took his wife out.
I feel that im in right on this situation. It was a used part, it was a used part that was checked out before i sold it. I would never sell a sever vital part especially it being used here on the forum if it was checked out first. I always try to resolve any problems with any customers so both parties are happy, but in this instant the customer was very rude and imature, and only point the finger in one direction. And i see his point but there is always the other factor to look at. The information he told when he i dropped the tranny off, the way he said drives on and off the track, and how he showed what he had in his car.

I could certainly turn around take out this clean looking tranny, wait a couple of weeks and then put it on the for sale section and glorify it to be a great working tranny because it's clean but does that mean that when the person finally puts it in and realizes its a shitball that I don't have to give him the money back, " It worked when I had it", is what I'll say. Sounds GOod Too MEE.
If anyone is interested there was a street ported motor in it with front mount ported turbo's PFC fuel injectors and a whole boat load of other ****. The owner who gave me the car is selling the motor with all ic piping, intercooler, motor, everything on the motor as a package if your interested let me know i will check the price I know it was pretty low price to

ive read this thread like five times now..in aw..id take this deal as a lesson well learned, no matter what there rep. is..ALWAYS cover your ***. especally something as vital as this. this could go back and forth all day, its your word against his..untill you guys can work something out. state what you want from one another and see if you can meet a happy medium..

I bought my 93 touring from a member on here. Siad all was great and just had a good bill of health from the rotory shop. Turned out the motor was blown. I bought it as if it did run. I had to put a new motor in it. Nothing I could do about it...you have to remember....these products are AS IS without Warranty unless implied...

Hahahahahaha look man the guy doesn't drive fast nor does he abuse the car, but i can understand how hard it is to believe me when your the victim. Take what ever it is i said as back up on my defense and do as you will. I will not trash this thread, nor get into a bitch fest with your imature lack of education, and needless profanity and foul language. As grown adult you should be more aware of the choice of words you choose and how you come off on people when trying to resolve a problem or situation. I wish I had dealt with him through PayPal, although i paid him straight up cash.
I don't know what the medium is, probably him coming to pick up this tranny, i'll give him money for gas(as a lesson learned) but he would have to pay me back the majority of the money.
I don't know what the medium is, probably him coming to pick up this tranny, i'll give him money for gas(as a lesson learned) but he would have to pay me back the majority of the money.

Oh just remember i told you to do paypal but you wanted pay in cash. So all in all it is a lesson learned for both of us. Im sorry things turned out the way they did, but im not no ******* bitch like some forum members who sell on the forum do other forum members dirty and then are no where to be found, when he/she is trying to get answers for a broken part. I don't have time for the kid ****, i got to much going on in my own life to deal with petty bull **** games, and i have nothing to hide.

well like other people said, it's your word against mine, Karma's a bitch you'll get yours, I'm not tripping, This will just show what kind of person Teddy is and what to expect from him, how he resolves issues. My use of words has nothing to do on how educated I am, shows how pissed off I am that some one who sells themselves off to be something and end up trying to pull one on people. I'm sure you need it more than I do.

dude, not that Im taking sides with anyone here..I don't know either of you.
BUT my opinion, from an outside prospective, when you buy something thats USED, Stated that its been SALVAGED from a wreck....theres shouldnt be refunds. Teddy should have warned you that theres a chance it could be faulty, although it was in good condition when it was in the working car. But in reality theres no 500 dollar test going to be done to see if the tranny works after the wreck so you should REALIZE that theres a chance for failure on your own, you bought a dirt cheap tranny, from a wrecked car, that was used for a while to begin with. That is why a verified working tranny goes for more than 300 dollars.
Maybe refund half of the money?
I mean its almost like saying...I bought a 600 dollar engine from a wrecked car that was used for 75,000 miles that was running fine before the wreck, but didnt pay to have it compression checked. I wouldnt buy it unless its compression checked....since the tranny wasnt professionally inspected I would have never purchased it unless I was willing to take the chance on my money...now if the tranny came out of a perfectly working car that hadn't wrecked, or you hadn't known about the wreck, this would be a different story...the fact is the tranny was involved in a wreck and neither party has spent the money to prove mechanical working order so no garuntees!
